Website Terms & Conditions

1. About these terms

These terms govern your use of the Kinross Curling website and associated online services.

Separate booking, cancellation, membership, competition or facility rules may also apply to particular services. Where applicable, those rules will be made available as part of the relevant booking or service.

By using this website you agree to use it in accordance with these terms.

2. About us

This website is operated by:

Kinross Curling
Green Road
Kinross
KY13 8TU
Telephone: 01577 861821
Email: [EMAIL]

3. Website availability

We aim to keep the website and online booking facilities available and accurate, but we do not guarantee uninterrupted availability.

We may temporarily suspend or restrict access for maintenance, security, upgrades or circumstances outside our reasonable control.

4. Website information

We take reasonable care to ensure information published on the website is accurate and up to date.

Information about activities, sessions, events, availability, prices and facilities may change. Where there is an obvious error, please contact us so that it can be corrected.

5. Customer accounts

Some services may require or allow you to create a Customer account.

You must provide accurate information when registering and keep your details reasonably up to date.

You are responsible for keeping your password and account credentials secure and should not knowingly allow another person to use your account without appropriate authority.

Please notify us if you believe your account has been accessed without permission.

We may suspend an account where reasonably necessary to protect customers, Kinross Curling or the security of our systems.

6. Bookings

Bookings may be available for activities including curling sessions, classes, coaching, events and facilities.

A booking is subject to:

  • availability;
  • any eligibility or age requirements;
  • the applicable price;
  • the information displayed during booking;
  • any specific cancellation conditions; and
  • successful payment where payment is required to confirm the booking.

You are responsible for checking the booking details before completing the transaction.

A booking reference or confirmation will normally be provided when a booking has been successfully created or confirmed.

7. Booking for other people

Where you make a booking for another participant or a group, you confirm that you are authorised to provide the necessary information and make the booking on their behalf.

You are responsible for ensuring participants are aware of relevant booking conditions, eligibility requirements and facility rules.

8. Prices

Prices are shown in pounds sterling and will be displayed before you complete a booking.

The amount payable may depend on factors including:

  • activity or facility;
  • date and time;
  • duration;
  • ticket type;
  • participant eligibility;
  • membership or season-pass entitlement;
  • applicable discounts or promotions.

The final price applicable to your booking will be shown during the booking process.

9. Payment

Payment may be required online, requested after a booking is created, or accepted by another method depending upon the type of booking.

Online card payments are processed through our payment provider.

A booking may remain unconfirmed until any required payment has been successfully received.

Where a season pass, credit or other entitlement is used, its applicable conditions and remaining balance will apply.

10. Cancellations and amendments

The ability to cancel or amend a booking, and whether a refund or credit is available, depends upon the cancellation terms applicable to that booking.

The relevant cancellation conditions should be displayed or made available before the booking is completed.

Where a booking is cancelled by Kinross Curling because an activity cannot proceed — for example because of facility availability, safety concerns, adverse conditions or another operational reason — we will deal with any payment, refund, credit or rearrangement in accordance with the applicable booking conditions.

[KINROSS SHOULD INSERT/APPROVE ITS ACTUAL CANCELLATION AND REFUND POLICY HERE OR LINK TO IT.]

This is an important section to finalise alongside the cancellation/credit functionality rather than inventing cancellation rights in the website terms.

11. Classes, activities and events

Participants must comply with reasonable instructions from Kinross Curling staff, coaches and officials.

Some activities may have eligibility requirements, including age restrictions, experience levels or participant limits.

Kinross Curling may refuse participation where reasonably necessary for safety, eligibility or operational reasons.

12. Safety

Curling and other sporting activities involve inherent physical risks.

Participants are responsible for following safety instructions and behaving responsibly while using Kinross Curling facilities.

Participants should make Kinross Curling aware of any relevant matter that may affect their safe participation where appropriate.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

13. Children and young people

Bookings involving children or young people must be made or authorised by an appropriate adult where required.

The person making the booking is responsible for ensuring that the correct participant and age information is supplied.

Additional safeguarding or supervision requirements may apply to particular activities.

14. Behaviour and use of facilities

Visitors and participants must behave reasonably and must not:

  • endanger themselves or others;
  • damage facilities or equipment;
  • behave abusively towards staff, volunteers or other users;
  • deliberately interfere with other activities; or
  • use facilities for unlawful purposes.

Kinross Curling may require a person to leave or may restrict future access where reasonably necessary because of serious or repeated misconduct.

15. Website use

You must not knowingly:

  • attempt to gain unauthorised access to the website or its systems;
  • interfere with the operation or security of the website;
  • introduce malicious software;
  • use automated systems to place excessive load on the website;
  • impersonate another person; or
  • use the website for unlawful or fraudulent purposes.

16. Intellectual property

Unless otherwise stated, website content including text, graphics, branding, photographs and other material is owned by, licensed to, or used with permission by Kinross Curling.

You may view and print website material for personal, non-commercial use.

You must not reproduce, commercially exploit or redistribute protected website content without appropriate permission.

17. Third-party websites and services

The website may contain links to external services and websites.

These links are provided for convenience and do not necessarily imply endorsement. Kinross Curling is not responsible for third-party websites or services outside its control.

Third-party services may be subject to their own terms and privacy policies.

18. Liability

Nothing in these terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence or liability for fraud.

Subject to applicable law, Kinross Curling is not responsible for losses that were not reasonably foreseeable when the relevant service was provided or for losses resulting from circumstances outside its reasonable control.

These terms do not affect any statutory rights you have as a consumer.

19. Privacy

Personal information supplied through the website and booking system is handled in accordance with our Privacy Policy.

20. Changes to these terms

We may update these terms where reasonably necessary, for example to reflect changes in our website, booking services or legal requirements.

The version applying to a booking will ordinarily be the version in force when that booking is made, together with any booking-specific terms presented at the time.

21. Governing law

These terms are governed by the laws of Scotland.

If you are a consumer, you retain any rights you have under applicable consumer law concerning where proceedings may be brought.
